1 Acceptance of Terms
By accessing or using TillNex ("the App"), operated by MistNex Dynamics ("we", "our", or "us"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the App. We may update these terms at any time; continued use after notification of changes constitutes acceptance.
2 Description of Service
TillNex is a point-of-sale (POS) application designed for businesses operating in Zimbabwe. The App provides features including but not limited to: sales processing, inventory management, shift management, expense tracking, customer credit/wallet management, and sales reporting. Access to the App requires an active subscription and an approved access key issued by MistNex Dynamics.
3 Account Registration & Access
To use TillNex you must submit a registration request through the App. Upon approval by MistNex Dynamics, you will receive an access key that activates your account.
- You are responsible for maintaining the confidentiality of your credentials.
- You must provide accurate and complete business information during registration.
- One account may be used across multiple devices belonging to the same business.
- You agree not to share your access key with unaffiliated third parties.
- MistNex Dynamics reserves the right to suspend or terminate accounts that violate these terms.
4 Subscriptions & Payments
TillNex is offered on a subscription basis. The following terms apply:
- Subscription fees are charged according to the plan selected at the time of activation.
- Subscriptions must be renewed before the expiry date to maintain uninterrupted access.
- Upon expiry of a subscription, sales processing features will be suspended until renewal.
- All fees are quoted and payable in the currency specified in your plan (USD or ZWL).
- MistNex Dynamics reserves the right to adjust pricing with 30 days' notice.
- Refunds are offered at the sole discretion of MistNex Dynamics.
5 Acceptable Use
You agree not to use TillNex to:
- Process transactions for illegal goods or services.
- Circumvent, disable, or interfere with the App's security features.
- Reverse-engineer, decompile, or attempt to extract the App's source code.
- Use the App for any purpose other than legitimate business sales and management.
- Transmit any malicious code, viruses, or disruptive content.
- Share or resell access to the App without written consent from MistNex Dynamics.
6 Intellectual Property
All content, features, design, logos, and code within TillNex are the exclusive property of MistNex Dynamics and are protected by applicable intellectual property laws. The TillNex name, the TN logo, and the MistNex Dynamics brand are trademarks of MistNex Dynamics. Nothing in these terms grants you any right to use our trademarks or branding.
7 Your Data
You retain ownership of all business data you enter into TillNex, including product information, sales records, customer data, and financial records. By using the App, you grant MistNex Dynamics a limited licence to store and process this data solely for the purpose of providing the service. We do not sell your business data to third parties. Please refer to our Privacy Policy for full details on how your data is handled.
8 Disclaimer of Warranties
TillNex is provided on an "as is" and "as available" basis. To the maximum extent permitted by law:
- We do not warrant that the App will be uninterrupted, error-free, or free of viruses.
- We do not warrant the accuracy or completeness of any reports or calculations generated by the App.
- You are responsible for maintaining backups of your critical business data.
9 Limitation of Liability
To the fullest extent permitted by applicable law, MistNex Dynamics shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of TillNex. Our total liability for any claim arising from the use of the App shall not exceed the total subscription fees paid by you in the 30 days preceding the event giving rise to the claim.
10 Termination
We reserve the right to suspend or terminate your access to TillNex at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the App ceases immediately. You may request an export of your business data within 30 days of termination.
11 Governing Law
These Terms and Conditions are governed by the laws of the Republic of Zimbabwe. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Zimbabwe.
